Who we are and what this covers
This Privacy Policy explains how NEX-GEN Athletics (“NEX-GEN Athletics”, “we”, “us”) collects, uses and protects information when you visit www.nexgenathletic.com, complete an intake, join our email or text list, book a consult, or purchase a plan or program. It also describes the choices you have.
NEX-GEN Athletics is an executive health concierge and nutrition, training and health-protocol coaching practice led by Jason Johns. We are not a medical provider and this site is not a patient portal. Information you share with us is handled as confidential client information, but it is not “protected health information” under HIPAA unless we tell you otherwise in a separate written agreement.
Information we collect
Information you give us. Name, email address, mobile number, location, the service tier you are interested in, and anything you choose to tell us in the intake about your goals, training history, health history, medications, supplements, labs and lifestyle. The intake asks for sensitive health information so that we can decide whether and how we can help; share only what you are comfortable sharing.
Payment information. Payments are processed by a third-party payment processor (for example Square or Stripe). Your card or bank details are entered on and stored by that processor, not on our servers. We receive confirmation of payment, the last four digits of your card, and your billing contact details.
Information collected automatically. Standard web-server logs (IP address, browser type, pages viewed, referring page, approximate location) and a small number of cookies and local-storage values that remember whether you have dismissed the welcome offer and keep forms working. We do not run third-party advertising trackers on this site.
How we use it
- To respond to your intake, consult request or Executive Concierge application and to deliver the plans and services you purchase.
- To design and personalize your protocol, including coordinating — with your permission — with your physician, functional-medicine provider or other practitioners you name.
- To send transactional messages: confirmations, receipts, scheduling, check-in reminders and plan deliveries.
- To send marketing email and, only if you opted in, text messages about protocol releases, launch codes and NexGen family announcements. You can opt out at any time (see below).
- To run, secure and improve the website, prevent fraud and comply with legal obligations.
Text messaging (SMS) terms
By checking the text-message box on one of our forms you give express written consent to receive recurring automated marketing and informational text messages from NEX-GEN Athletics at the mobile number you provided. Consent is not a condition of purchase. Message frequency varies but is typically no more than four messages per month. Message and data rates may apply.
Reply STOP to any message to cancel. Reply HELP for help, or contact us at supplementgraveyard@gmail.com or (703) 297-7034. Carriers are not liable for delayed or undelivered messages. Mobile numbers and text-message opt-in data will not be shared with third parties or affiliates for their own marketing purposes.
Email marketing
Every marketing email includes an unsubscribe link. Unsubscribing from marketing does not stop transactional messages about services you have purchased.
Retention and security
We keep intake and client records for as long as you are a client and for up to seven years afterward to meet record-keeping, tax and professional obligations, unless you ask us to delete them sooner and we are not required to keep them. We use reputable hosted providers, encrypted connections (HTTPS) and access controls. No method of transmission or storage is perfectly secure; if a breach affects your data we will notify you as required by law.
Your choices and rights
- Access, correct or delete. Email us and we will provide, correct or delete the personal information we hold about you, subject to legal retention requirements.
- Opt out. Reply STOP to texts; use the unsubscribe link in emails; or email us.
- Virginia residents. The Virginia Consumer Data Protection Act may give you additional rights to access, correct, delete and obtain a copy of your data and to opt out of targeted advertising and sale (we do neither). Submit requests to the email below; we respond within 45 days and you may appeal a decision by replying to our response.
- Other states and countries. If you are located elsewhere, we will honor the rights that apply to you under your local law.
Children
Our services are for adults. We do not knowingly collect information from anyone under 18. Youth athletes are served only through a parent or guardian who is our client.
Changes and contact
